Children & Protection
Child in danger?

We are dedicated to upholding laws that promote children’s rights and welfare. As some of the most vulnerable members of our society, children deserve robust legal protection. In Indonesia, this includes safeguarding them from all forms of violence, exploitation, neglect, and abuse. Our legal practice extends to a wide range of issues, from child custody disputes and adoption processes to cases involving juvenile justice and child-related civil disputes, ensuring the best interests of the child are always the top priority.

Despite a strong legal framework, children in Indonesia still face significant legal challenges. Common issues that require our legal intervention include:

  • Abuse and Neglect: Children are unfortunately often victims of physical, emotional, or sexual abuse, and they require strong legal advocates to secure their safety and bring perpetrators to justice.

  • Custody Disputes: When a marriage ends, a child’s welfare can become a contentious issue. Legal guidance is necessary to navigate the complexities of child custody and guardianship arrangements.

  • Juvenile Justice: Children who come into conflict with the law require a specialized approach that focuses on their rehabilitation rather than punishment, as mandated by Indonesian law.

  • Civil Registry Issues: Problems with birth certificates, names, or legal status can affect a child’s fundamental rights to education, health services, and identity.

Our work is governed by the primary laws that form the foundation of children's rights in Indonesia:

  • Law No. 23 of 2002 on Child Protection, as amended by Law No. 35 of 2014: This is the core legislation that guarantees a child’s right to survival, growth, protection, and participation. It outlines the responsibilities of the state, parents, and society.

  • Law No. 11 of 2012 on the Juvenile Justice System: This law establishes a separate judicial system for children in conflict with the law, emphasizing restorative justice and a child's right to legal counsel.

  • Marriage Law No. 1 of 1974: This law, particularly in its provisions on divorce, establishes the legal framework for child custody and support obligations for parents.

We apply our expertise by providing a strategic and sensitive approach to every case involving a child. For child protection cases, we work with legal and social authorities to ensure the child is removed from harm and that legal proceedings are initiated against those responsible. In custody disputes, we meticulously analyze the facts to present a compelling case that supports the child's best interests in court. Our deep understanding of the Juvenile Justice System enables us to provide effective defense for children in conflict with the law, advocating for restorative solutions and ensuring their rights are not violated. In every case, our commitment is to provide a legal shield for children, ensuring their voices are heard and their legal protections are upheld.
